Our liability for delays, errors, or omissions is limited to correction of the work or refund of amounts paid for defective work. These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability).

Indemnification

Customer agrees to indemnify and hold harmless Christian Brothers Roofing, its officers, employees, and contractors from any claims, damages, or expenses (including attorney fees) arising from: customer's breach of this agreement, customer's negligence or willful misconduct, third-party claims related to customer's property or actions, or disputes with customer's insurance company regarding coverage or payment.

Property Access and Site Conditions

Customer grants us reasonable access to the property during normal business hours (7:00 AM - 6:00 PM) for the duration of the project. Customer is responsible for: removing or protecting personal property and vehicles, providing access to electrical outlets and water, securing pets, and disclosing known hazardous conditions (asbestos, lead paint, structural issues). We reserve the right to suspend work if site conditions pose safety risks until conditions are remedied.

Permits and Code Compliance

We obtain required building permits for most projects and ensure work complies with applicable building codes. Permit costs are typically included in project pricing unless otherwise specified. Customer is responsible for homeowner association (HOA) approval if required. Permit timelines are beyond our control and may affect project start dates.

Dispute Resolution

Any disputes arising from our services or this agreement shall be resolved as follows: (1) Informal Resolution: Parties agree to first attempt good-faith negotiation; (2) Mediation: If negotiation fails, disputes shall be submitted to non-binding mediation before a neutral mediator; (3) Arbitration: If mediation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association; (4) Venue: Any legal proceedings shall be conducted in Dallas County, Texas; (5) Governing Law: This agreement is governed by Texas law. Customer retains the right to pursue claims in small claims court for matters within that court's jurisdiction.

Severability

Hidden damage, structural issues, or code violations discovered during work may require additional repairs not included in the original estimate. We will notify customers of additional work required and obtain approval before proceeding with costs exceeding $500.

Weather and Acts of God

We are not responsible for delays, damage, or inability to perform services due to severe weather, natural disasters, or other acts of God beyond our reasonable control. This includes hurricanes, tornadoes, floods, ice storms, and extreme weather events common in Texas.

Subcontractors

We may use qualified subcontractors for specialized work (electrical, plumbing, concrete, masonry). All subcontractors are properly licensed and insured. We maintain responsibility for overall project quality and coordination.

Compliance with Laws
